The Malta Tourism Authority (MTA) will take legal action against a timeshare company that allegedly breached its terms on a sale to two Britons.

The MTA said that Gordon Lamont will be called as a witness against Access2Leisure, the timeshare company in question. Lamont purchased a three-year contract from the developer in 2007, which he later upgraded to a long-term contract after being highly satisfied with the service upon his return from Malta in 2008.

However, on his second vacation, Lamont was given substandard products and services, including lodging. Despite his complaints about the lodging, he was not given alternative accommodations. Instead, the company offered him a stay at the club showroom on the condition that he had to vacate it 10AM to 4PM everyday.

During this time, Lamont upgraded his membership to premier and he was asked to pay an additional €5,000.

“I decided at this point that all was not what it was supposed to be with this club, and told them that I would talk to my wife about our holiday next year and left the offices,” explained Lamont. “When we got back to the UK the next day I cancelled my cheque to Access2Leisure.”

After several complaints to the MTA and the Consumer Division, Lamont was informed that the company allegedly violated an offense in his contract by accepting a deposit on the first day when no payment should have been made for a 10-day “cool-off” period.

“We are very disappointed with Access2Leisure. We would have been happy to go back to Malta every year if only they gave us what they promised,” comments Lamont. “They lied to us to get us to join their club, treated us like idiots when they changed the membership to include the premier membership and deny us access to resorts that were on our portfolio.”
