Florida’s Attorney General Bill McCollum has filed an injunction and a lawsuit against two Palm Beach County-based timeshare resale companies, who have allegedly collected $4 million worth of marketing fees, but have not made any efforts to sell units.
Last Monday, the Attorney General’s Office claimed that the scheme has ensnared at least 400 people.
Universal Marketing Solutions and Creative Vacation Solutions manager Jennifer Kirk reportedly charged marketing fees for timeshare resale advertisements.
The present lawsuit seeks to block the defendants from participating in the timeshare resale business. It will also demand for customers’ restitution, civil penalties, and reimbursement of fees and costs related to the investigation.
The implicated timeshare resale companies were soliciting money from online customers and through telemarketing.
The defendants are accused of violating the Florida Deceptive and Unfair Trade Practices Act and the Florida Telemarketing Act, as well as other laws that prohibit the collection of advance fees for timeshare sales.
