It's official—the Advertising Standards Authority has banned the distribution of an advertising brochure from Reclaim Ltd. The company's brochure, selling cashback promotions and under proliferation by unregulated holiday clubs, had been deemed by the ASA as misleading advertising.
Taking effect on the 19th day of January, the ruling was put in place after a complainant reported as having been given the misleading brochure during a meeting on timeshare sales. The complainant questioned the veracity of the brochure's claim that clients would be able to regain up to but not exceeding 95% of the certificate value of their timeshare investments.
To date, no client has been able to claim a figure approaching the 95% mark, reason for which is Reclaim's "sliding scale" system that affects claim eligibility based on the number of complainants. The unscrupulous promotion was found not only to be misleading, but also lacking in substance, thus earning the ASA ban.
