The new owners of the recently-closed Pelican Resort, now known as Simpson Bay Resort, are under legal wraps from complaints filed by Pelican timeshare owners. The owners had acted in good faith and paid their annual maintenance fees expecting to be able to use their timeshare properties in the resort in the future.
Speaking on behalf of the homeowners, lawyer Gerrit van Giffen says that the actions taken by current management to close down the resort back in February 20th is in direct violation of the promises made earlier by Royal and Simpson Bay, wherein they would honor all timeshare rights being paid for by timeshare property owners.
Meanwhile, a court summon had ordered the resort to "resume the managerial activities... by Saturday, February 26, 2011 and herewith advises your clients that if by then the resort is not fully operational and equipped for the proper use by the timeshare owners of the resort, that it shall seek an immediate relief.
